DMCA Policy

At Pasta Al Forno, we respect the intellectual property rights of others and expect our users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for copyright owners to report alleged copyright infringement and for users to submit counter-notifications if their content has been mistakenly removed.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. If we receive a valid notice, we will promptly remove or disable access to the infringing material and take appropriate action against the alleged infringer, which may include termination of their account.

Filing a DMCA Notice of Infringement

If you are a copyright owner or an agent thereof and believe that any content hosted on Pasta Al Forno infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Provide the specific URL(s) or other specific location(s) on Pasta Al Forno's site where the material that you claim is infringing is located. Sufficient information must be provided to allow us to locate the material (e.g., direct links to specific pages, posts, or images).
  3. Your contact information: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
  6. Your electronic or physical signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled, you may submit a counter-notification to our Designated Copyright Agent. Your counter-notification must include the following:

  • Identification of the material removed: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled (e.g., the URL(s) of the content).
  • Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Your name, address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Pasta Al Forno may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your electronic or physical signature: Your physical or electronic signature.

Please submit all DMCA notices and counter-notifications to our Designated Copyright Agent via our contact page, specifying "DMCA Notice" or "DMCA Counter-Notification" in the subject line.
